Brown & Brown is seeking a Claims Counsel, Management Liability to join our growing team! 

The Claims Counsel's primary function is to independently manage a portfolio of complex Management Liability claims, including Directors & Officers Liability, Employment Practices Liability, Fiduciary Liability, Crime, and related financial lines claims involving private companies and nonprofit organizations. 

The successful candidate will work closely with underwriting, carrier partners, brokers, insureds, and defense counsel to deliver superior claims outcomes while supporting the strategic growth of Nexus's Management Liability portfolio. This role requires deep technical expertise, sound business judgment, strong relationship management skills, and the ability to balance legal, coverage, financial, customer service, and portfolio considerations in claims decision-making. 

How You Will Contribute:   

Claims Management and Coverage Analysis 

• Independently manage a portfolio of complex and high-severity Management Liability claims. 

• Analyze policy coverage and prepare reservation of rights letters, coverage position letters, and declination letters. 

• Conduct detailed factual, legal, financial, and coverage analyses to evaluate liability, damages, and exposure. 

• Establish and maintain appropriate claim reserves within delegated authority and seek additional authority when required. 

• Evaluate settlement opportunities and participate in mediations, settlement conferences, and other dispute resolution proceedings. 

• Exercise sound judgment on complex coverage and litigation issues while maintaining consistency with claims handling guidelines and business objectives. 

Litigation Management 

• Direct litigation involving insured organizations and individual directors, officers, trustees, and executives. 

• Retain, manage, and evaluate defense counsel and coverage counsel. 

• Review and approve litigation budgets, monitor legal spend, and negotiate alternative fee arrangements when appropriate. 

• Develop and implement effective litigation and resolution strategies. 

Portfolio and Business Partnership 

• Serve as a trusted advisor to underwriting regarding claims trends, emerging risks, coverage issues, and portfolio performance. 

• Partner with underwriting teams to identify opportunities for product enhancement and improved risk selection. 

• Analyze claims trends and portfolio data to identify emerging exposures and provide actionable business insights. 

• Prepare timely, accurate reporting for carrier partners and reinsurers and participate in stewardship discussions and portfolio reviews. 

• Demonstrate a balanced approach that considers legal exposure, coverage intent, customer experience, broker relationships, and portfolio impact when making claims decisions. 

Broker and Market Engagement 

• Build and maintain strong relationships with retail and wholesale brokers, insureds, carrier partners, and defense counsel. 

• Participate in broker stewardship meetings, claim reviews, underwriting roundtables, and market-facing presentations as needed. 

• Represent Nexus professionally in interactions with brokers, insureds, carrier partners, counsel, and industry stakeholders. 

Leadership and Operational Excellence 

• Serve as a technical resource and mentor to less experienced claims professionals. 

• Participate in claims audits, quality reviews, training initiatives, and process improvement projects. 

• Support strategic initiatives designed to enhance claims operations and service delivery. 

• Embrace claims technology, automation, and AI-enabled tools to improve efficiency, consistency, and claim outcomes. 

• Ensure compliance with delegated authority agreements, carrier guidelines, service standards, and applicable regulations. 

Skills & Experience to be Successful:  

• Juris Doctor (JD) degree and active bar membership. 

• Minimum 7-10 years of experience handling Management Liability claims. 

• Demonstrated expertise in private company D&O, nonprofit organization liability, EPL, and Fiduciary Liability coverage analysis. 

• Significant experience drafting complex reservation of rights letters, coverage position letters, and declination letters. 

• Significant experience handling shareholder and ownership disputes involving closely held entities; governance and executive liability disputes; regulatory and governmental investigations; and bankruptcy, insolvency, trustee, receiver, creditor, and related executive liability claims. 

• Strong understanding of Management Liability policy forms, endorsements, and coverage structures. 

• Demonstrated ability to independently manage high-severity and complex claims. 

• Strong analytical, negotiation, litigation management, financial analysis, and relationship management skills. 

• Excellent written, verbal, and presentation skills. 

• Strong business and strategic decision-making capabilities. 

• Proficiency with Microsoft Office and claims management systems. 

• Ability to operate effectively in a small, collaborative, high-performing team consistent with company values. 

Preferred 

• Experience handling claims involving private equity-backed, venture-backed, founder-led, or closely held organizations. 

• Experience within an MGA, specialty insurer, E&S carrier, or Management Liability insurance carrier. 

• Experience operating under delegated claims authority. 

• Experience presenting claims trends, portfolio analytics, and emerging risks to senior management, underwriters, brokers, and carrier partners. 

• CPCU, RPLU, SCLA, ARC, or similar industry designation.

Pay Range

The pay range provided above is made in good faith and based on our lowest and highest annual salary or hourly rate paid for the role and takes into account years of experience required, geography, and/or budget for the role.
