Job Description

Basic Purpose

The Assistant General Counsel will be dedicated to the Oklahoma Medical Marijuana Authority (OMMA) ensuring effective implementation of statutes and rules.  The lawyer will assume all functions of planning, organizing and monitoring legal activities, interpreting laws and regulations, providing legal advice, counsel and assistance to OMMA. The Assistant General Counsel will be expected to work under minimal supervision with considerable latitude for the use of initiative and independent judgment in legal issues large in scope, complexity, and activity. 

Typical Functions

The specific functions of this position vary, but may include the following:  

• Acts as the primary contact for OMMA staff, addressing complex legal inquiries and providing advice. 

• Plays a key role in evaluating and drafting agency rules and proposed legislation.

• Assists in OMMA compliance functions, including providing support for investigations and providing representation in administrative proceedings. 

• Analyzes complex factual and legal issues and prepares legal opinions, briefs, pleadings and other legal documents; conducts legal research, reports findings, and advises on laws and regulations. 

• Presents cases before various courts, including administrative, state, federal, and appellate. 

• Works in a high-pressure environment, handling multiple tasks and deadlines. 

• Other duties as assigned.

• Works effectively in team environment, participating and assisting their peers.  

• Participates in the development and evaluation of program objectives and procedures.  

• Provides training and technical assistance to internal staff.   

Level Descriptor

This is the basic level of the job family, where employees are responsible for performing routine entry level legal work in a training status to build their skills related to providing legal counsel.  Assignments are prescribed, but the methods are not typically reviewed nor controlled while the work is in progress.  Works under the direct supervision of General Counsel, Deputy General Counsel, Managing Deputy General Counsel, or other supervisory-level Attorney.  

Knowledge, Skills, Abilities and Competencies

Knowledge, Skills, and Abilities required at this level include knowledge of applicable state and federal laws; applicable regulations; constitutional law and the Oklahoma constitution; agency policies and procedures; trial and hearing procedures; rules of evidence; methods and techniques for conducting legal research and writing. 

Skills required include critical thinking; conducting legal research; written and oral communication; Microsoft Office – Outlook, Word, PowerPoint, and Excel; attention to detail; sound judgment and decision making.

Abilities required include presenting statements of fact and law; clearly and logically articulate position in written and oral form; analyze, interpret, and apply various laws, rules, regulations, agency policies, and procedures; direct and/or perform independent and difficult research, analyzing, appraising, and applying legal principles and precedents to difficult legal or factual problems; conduct legal research on Westlaw, Lexis/Nexis, Fastcase, the Oklahoma State Court Network, and printed or internet-based legal resources; meet timelines while following the Oklahoma statutes, and represent the agency in a professional manner.

Education and Experience

Education and Experience requirements at this level consists of a Juris Doctor degree from an accredited law school, a license to practice law in State of Oklahoma, and membership in Oklahoma Bar Association.
