Lumentum is seeking an accomplished Global Trade Counsel to provide strategic legal guidance and practical business support across the company’s global trade activities. This high-impact role will advise leaders and cross-functional teams on export controls, economic sanctions, customs and import compliance, international trade regulations, and related geopolitical and supply-chain risks.

Key Responsibilities

Strategic Legal Counsel

  • Serve as a trusted legal advisor to business leaders and stakeholders on global trade matters affecting Lumentum’s products, technology, transactions, supply chain, and operations.
  • Provide clear, practical advice on U.S. and non-U.S. export controls, economic sanctions, customs and import requirements, antiboycott rules, and other international trade laws.
  • Assess the legal and business implications of evolving geopolitical developments, regulatory actions, tariffs, trade remedies, and government policy initiatives; communicate risks and recommended actions to senior leadership.
  • Support commercial, supply-chain, product, and operational decisions by identifying trade requirements early and developing risk-based, business-oriented solutions.
  • Partner with the Legal Department on agreements, transactions, investigations, disclosures, and other matters involving trade compliance considerations.

Export Controls, Sanctions & Technology Compliance

  • Advise on export jurisdiction and classification for hardware, software, technology, technical data, and services under the EAR, ITAR, and applicable non-U.S. regimes.
  • Analyze licensing requirements, license exceptions, exemptions, de-minimis and foreign direct product rules, reexports, retransfers, deemed exports, and controlled technology access.
  • Support the preparation, submission, and management of export license applications, commodity classifications, advisory opinions, and other government filings; monitor license conditions and provisos.
  • Advise on restricted-party, end-use, end-user, destination, diversion-risk, and sanctions screening; evaluate red flags and conduct risk-based due diligence and escalation.
  • Guide the development and implementation of Technology Control Plans and other controls governing access to controlled technology, technical data, and facilities.
  • Provide legal support for investigations, voluntary disclosures, directed disclosures, enforcement matters, and responses to government inquiries or audits.

Customs, Import & Trade Remedies

  • Advise on customs classification, valuation, country of origin, marking, admissibility, foreign-trade zones, and other import compliance requirements.
  • Assess the impact of tariffs, Section 301 and Section 232 measures, antidumping and countervailing duties, forced-labor restrictions, and other trade remedies on Lumentum’s products and supply chain.
  • Partner with Logistics, Supply Chain, Finance, and external customs brokers to resolve complex entry, clearance, post-entry, and duty issues and strengthen the accuracy and defensibility of import records.
  • Support customs audits, protests, prior disclosures, ruling requests, and other interactions with customs authorities in the United States and other jurisdictions.

Program Governance, Risk Management & Operations

  • Help develop, maintain, and continuously improve Lumentum’s global trade compliance policies, procedures, controls, training, and governance framework.
  • Establish risk-based processes for classification, licensing, screening, technology controls, import compliance, recordkeeping, and escalation across regions.
  • Conduct or oversee compliance assessments, internal reviews, audits, and risk analyses; track remediation activities and advise on control effectiveness.
  • Develop and deliver targeted training and communications that make complex trade requirements understandable and actionable for employees and business partners.
  • Promote consistent global standards while accounting for local legal requirements and operational realities across Lumentum’s international footprint.
  • Champion the responsible use of trade compliance technology, automation, data analytics, and artificial intelligence to improve visibility, efficiency, and control effectiveness.

External Engagement & Strategic Contribution

  • Represent Lumentum, as appropriate, in engagements with U.S. and non-U.S. government agencies, regulators, industry associations, outside counsel, and other external stakeholders.
  • Monitor legislative, regulatory, and enforcement developments and coordinate timely impact assessments and business communications.
  • Build strong relationships across the company and serve as a visible advocate for ethical, compliant, and commercially practical global trade practices.
  • Contribute to the broader Legal Department’s strategic priorities and support a culture of sound judgment, accountability, and continuous improvement.

Qualifications

  • Juris Doctor (J.D.) or equivalent law degree required; active bar membership in at least one U.S. jurisdiction preferred.
  • 15+ years of experience advising on international trade, export controls, economic sanctions, customs, or a related legal and compliance discipline; experience in a multinational technology or manufacturing company strongly preferred.
  • Demonstrated expertise in the EAR, ITAR, OFAC sanctions, U.S. customs laws; experience with related non-U.S. trade regimes preferred.
  • Practical experience with export classifications, licensing, deemed exports, technology-control programs, restricted-party screening, customs matters, trade remedies, investigations, and government inquiries.
  • Strong understanding of how trade requirements intersect with product development, engineering, supply chain, manufacturing, logistics, sales, procurement, and commercial transactions.
  • Excellent legal judgment and the ability to assess complex, incomplete, or fast-changing facts and provide clear, timely, and actionable recommendations.
  • Exceptional written, verbal, and executive communication skills, including the ability to explain technical legal concepts to non-legal audiences.
  • Strong relationship-building and influencing skills, with the ability to collaborate effectively across functions, cultures, and jurisdictions.
  • Self-directed, pragmatic, and solutions-oriented, with the ability to manage multiple priorities in a fast-paced global environment.
  • Fluency in English required; additional language skills and experience working across Asia, Europe, or other international regions are a plus.
