About the Position

Our Specialty Court Prosecutors are responsible for handling cases on behalf of the Maricopa County Attorney’s Office in the Probation Violation Courts and in various other specialty courts. Duties include representing the State in probation violation proceedings, which involves the review of felony matters in which defendants are alleged to have violated the terms of their probation. Specialty Court Prosecutors also make appropriate sentencing recommendations, respond to oral and written motions, and conduct evidentiary hearings as needed. 

This position also requires prosecutors to respond to post-conviction motions in various cases, including motions to modify probationary terms and to restore civil rights.  Specialty Court Prosecutors may be called upon to represent the State in other specialty courts such as Drug Court, DUI Court, Veterans Court, and Mental Health Court. The specific assignment to a court or transfer to a new assignment performing comparable work is possible and at the sole discretion of the County Attorney.

This recruitment is utilized to fill Prosecutor levels I – II positions. The level and compensation offered will be based on the education and experience provided on the application.   

  • Prosecutors hired at a level I will be compensated at a range of $82,250.00 - $108,750.00

  • Prosecutors hired at a level II will be compensated at a range of $102,000.00 - $148,500.00 and must have a minimum of three years of directly applicable experience or six years minimum experience as an attorney in an unrelated field.

Typically, successful candidates are hired at a salary rate up to the midpoint of the range, based on relevant experience, internal equity, and budgetary allowances.

We Require 

  • Three years of experience for Prosecutor II consideration

  • Juris Doctor (JD) from an accredited and American Bar Association (ABA) approved law school

  • Must be admitted to practice law and a member in good standing with the State Bar of Arizona at the time of hire

  • Valid Arizona driver's license upon hire

  • May be required to travel to perform certain work functions

Job Contributions 

  • Represent the State in probation violation court hearings and other specialty courts as needed

  • Manage high-volume, fast-paced court calendars

  • Ensure compliance with discovery requirements in probation revocation matters

  • Conduct revocation hearings and other evidentiary hearings as required

  • Handle specialized calendars, particularly cases where defendants have failed to complete diversion programs, including analyzing cases to determine appropriate plea offers, making diversion re-entry decisions, and making sentencing recommendations.

  • Draft appropriate and accurate plea agreements

  • Advocate both orally and in writing on behalf of the State

  • Make oral and written sentencing and disposition recommendations

  • Assist victims in asserting their rights at any hearing

  • Review and respond to motions in felony cases as assigned

  • Properly documents and closes case files in accordance with MCAO policies and procedures

  • Comply with all rules regulating professional responsibility

  • Cover court and other duties as assigned

Knowledge 

  • Knowledge of and compliance with Arizona statutes, rules, professional ethics, department policies/procedures, judicial officer deadlines, and victims' rights. Refusal or disregard could result in an ethical violation, a legal violation, and an impact on the community as a safety hazard, potentially leading to contempt orders or fines for the department. The stakes are very high that cases are managed effectively

Skills 

  • Prosecutors must prioritize their work to effectively manage their caseload  

Ability 

  • Effectively manage a high-volume criminal case load  

  • Effectively supervise work performed by assigned paralegal

  • Effectively communicate and collaborate with immediate peers, law enforcement officials, immediate supervisor, victims, judicial officers, defense counsel, and/or community members. Communication includes utilizing email, phone calls, in-person, virtual, meetings, and Court 

  • Must be able to use a computer and phone 

  • Must be able to attend court and meet with victims 

  • Must be fluent in English  

  • Must possess excellent verbal and written communication skills.  

  • Must be able to gain cooperation, persuade, and influence other people  

  • Must have a good working knowledge of Microsoft products  

  • Ability to travel to and from various county locations for court appearances, meetings, and trainings, utilizing personal or county-owned vehicles

  • Ability to use appropriate discretion, which varies depending on the level of Prosecutor and experience. Eventually, an experienced Prosecutor will be expected to make charging decisions, decisions about case resolutions, and how to try a case 

  • Must learn and regularly use MCAO’s computerized case management system and comply with case organization requirements

Working Conditions 

  • The position requires working in an office and courtroom setting in a high-volume, fast-paced environment with frequent stressful situations

  • The position requires travel up to 0.5 miles, standing for prolonged periods (up to 2 hours), lifting up to 25 pounds, carrying up to 10 pounds, pulling/pushing up to 5 pounds, climbing stairs (minimal if elevators are not operational), cramped or confined space, and repeating motions with wrists, hands, fingers, etc. 

  • The position requires accuracy, concentration/vigilance, decision making, responding to emergencies (on call), frequently changing tasks, high volume of work, handling multiple or complicated tasks, interruptions, working over 40 hours per week, public contact, stressful situations, teamwork, time pressures, unscheduled tasks, and working in close proximity with others 

  • The position may be exposed to emotionally charged situations, traumatic subject matter (crime scenes, accidents, etc.), working indoors, outdoors while traveling to court, meetings, or work, bright lighting, driving (court, crime scene response, or meetings), heat (walking to court, work, or meetings), and noise
